1. The Contract
We must receive payment in whole for the price of the goods that you order before your order can be accepted. Once your order has been despatch, you enter into a legally binding contract between us. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site. Any other individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify do not use this site.
2. Pricing, Delivery and Discount Codes
The prices payable for goods that you order are as set out in our website.
All items are handmade to order. Please allow up to 4 weeks for delivery. Postage is £5.50 for Special Delivery which will insure your item for loss or damage. Shoes, Wellies and Umbrellas will be sent by Parcelforce for £4.95. By Gina Ltd will not be responsible for loss or damage of any item sent via this method.
We may from time to time offer promotional discount codes (either directly or via third parties) which may apply in respect of any, or certain specified, purchases made though this website. Such codes may only be applied to purchases of full-price items and cannot be used in conjunction with any other offer or discounts. They are valid on new orders only.
3. Right for you to Cancel
You may cancel your order with us at any time up to the end of the seventh working day from the date you receive the ordered goods. Should you not be completely satisfied with your purchase, we will refund the total cost of your order excluding postage on goods returned within 7 days of receipt. No returns are accepted after this period. Goods must be returned by Royal Mail Special Delivery. The items you wish to return must be unworn and in good condition with their original packaging for us to issue a full refund or an exchange. We will do this within 28 days of receipt. Refunds will be made to the original payment card used for your order. For your own protection you should obtain a Proof of Posting from the Post Office so that you can claim from them for any lost parcels. Please note that we do not refund delivery charges, or the cost of returns postage except where the return is the result of our own error.Bespoke items or items which have been tailored to your individual requirements, cannot be returned unless faulty.We are unable to accept the return of earrings in compliance with current Health & Hygiene Regulations.
We will deliver the goods ordered by you to the address you give us for delivery at the time of order. It is your responsibility to ensure that the delivery address you give us is correct and accurate and that there is somebody to sign for and take delivery of the goods. Any delivery timescales quoted to you are indicative only. By Gina Ltd does not accept any liability whatsoever for delayed delivery caused by any third party. You will become the owner of the goods you have ordered when they have been dispatched to you. Once goods have been delivered to you we will not be liable for their loss or destruction. If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs.
If the goods we deliver are not what you ordered, are damaged, defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us of the problem within 7 working days of the delivery of the goods. If you do not receive goods ordered by you within 28 working days of the date on which you ordered them, we shall have no liability to you unless you notify us by e-mail or telephone within 7 days of the expected delivery date. If you notify us of a problem under this condition, our only obligation will be, at your option either:
- to make good any shortage or non-delivery; or
- to replace any goods that are damaged or defective; or
- to refund to you the amount paid by you for the goods in question in whatever way we choose
We will not be liable to you for any indirect or consequential loss, damage or expenses arising from any problem you notify us. We shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by e-mail to our contact address at firstname.lastname@example.org and all notices from us to you will be displayed on our website from time to time.

10. Events beyond our Control
We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
